Acceptance of Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and SylvanSport, LLC (“SylvanSport,” “we,” “us,” or “our”), a North Carolina limited liability company located at 21 Welcome St., Brevard, NC 28712.

By accessing or using our website (sylvansport.com) or any associated mobile site, application, or service (collectively, the “Site”), or by placing an order for any SylvanSport product, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

Eligibility & Geographic Scope

Our Site and products are available to residents of the United States and Canada who are at least 18 years of age. By using the Site, you represent and warrant that you meet these requirements.

We do not knowingly sell to persons under the age of 18. If we become aware that a customer is under 18, we reserve the right to cancel any order placed by that individual.

While our Site may be accessible from other jurisdictions, SylvanSport makes no representation that the products or content available on the Site are appropriate or available for use in locations outside the United States and Canada. Access to the Site from territories where its content or products are illegal is prohibited.

Account Registration

Certain features of the Site may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately at info@sylvansport.com if you suspect any unauthorized use of your account. SylvanSport will not be liable for any loss arising from your failure to maintain the security of your account.

We reserve the right to terminate accounts, remove content, or cancel orders at our sole discretion if we believe a violation of these Terms has occurred.

Products & Pricing

Product Descriptions
We strive to describe and display our products accurately. However, we do not warrant that product descriptions, images, specifications, pricing, or other content on the Site are error-free, complete, reliable, current, or free of inaccuracies. Product colors may appear differently due to monitor settings. If a product offered by SylvanSport is not as described, your sole remedy is to return it in accordance with our Returns Policy.

Pricing
All prices are listed in U.S. Dollars (USD) unless otherwise indicated. Canadian customers will be charged in USD; currency conversion and any associated fees are the responsibility of your financial institution.

Prices are subject to change without notice. We reserve the right to correct any pricing errors and to cancel or refuse orders placed at an incorrect price, even if the order has been confirmed and payment has been processed.

Availability
All products are subject to availability. We reserve the right to discontinue any product at any time. For customized or built-to-order products (such as campers and trailers), production timelines are estimates and may vary. SylvanSport will not be liable for delays beyond our reasonable control.

Orders & Payment

Order Acceptance
Placing an order on our Site constitutes an offer to purchase. All orders are subject to acceptance by SylvanSport. We reserve the right to accept, decline, or limit any order for any reason, including without limitation product availability, errors in product or pricing information, or concerns regarding fraud.

Your receipt of an order confirmation email does not constitute our acceptance of your order. Acceptance occurs when we process your payment and ship or otherwise fulfill the order (or, for trailers, when we confirm production scheduling).

Payment
We accept major credit cards and any other payment methods displayed on the Site. By providing payment information, you represent and warrant that you are authorized to use the designated payment method. All payment information is encrypted using SSL technology and processed by a PCI-compliant payment processor. SylvanSport does not store your full credit card number.

Taxes
Applicable sales tax will be collected on orders shipped to states where SylvanSport is required by law to collect sales tax. Canadian customers are responsible for all applicable duties, taxes (including GST/HST/PST), and customs fees, which may be assessed upon delivery.

Shipping & Delivery

Shipping options, costs, and estimated delivery times are presented at checkout. Delivery timelines are estimates only and are not guaranteed. SylvanSport is not responsible for delays caused by carriers, customs, weather, or other circumstances outside our control.

Risk of loss and title for products purchased from SylvanSport pass to you upon our delivery of such products to the carrier. For large towable products (campers and trailers), delivery or pick-up arrangements will be communicated separately.

International / Canadian Shipments
Orders shipped to Canada are subject to applicable import duties, taxes, and brokerage fees, which are the sole responsibility of the customer. SylvanSport cannot be held responsible for delays caused by customs processing.

Important: Original shipping charges are non-refundable on returned items. Return shipping costs are the responsibility of the customer unless the return is due to a SylvanSport error or defective product.

We do not process direct exchanges. To exchange an item, return it for a refund and place a new order. Placing the new order first ensures product availability while your return is in transit.

Warranty

SylvanSport products are backed by a limited warranty as described on our Warranty page, which is incorporated into these Terms by reference. The warranty provides specific rights to you, and you may also have additional rights that vary by state or province.

Warranty claims must be submitted through our official support channels. Products that appear defective or damaged upon receipt should be reported to us before initiating a standard return.

Independent dealers are separate legal entities and may offer their own warranty terms. SylvanSport is not responsible for dealer warranty obligations beyond those described in SylvanSport’s own limited warranty.

Intellectual Property

All content on the Site—including but not limited to text, graphics, logos, photographs, product designs, video, and software—is the property of SylvanSport, LLC or its licensors and is protected by U.S. and international copyright, trademark, patent, and other intellectual property laws.

SylvanSport’s patents are listed at sylvansport.com/patents. The SylvanSport name, GO™, GOAT™, GO EASY™, VAST™, TraiLOFT™, and LOFT™ are trademarks or registered trademarks of SylvanSport, LLC.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from this Site without our prior written consent, except as necessary to view or use the Site for its intended purpose.

User-Generated Content

If you submit reviews, testimonials, photographs, videos, or other content (“User Content”) to SylvanSport or its affiliated platforms, you grant SylvanSport and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content worldwide in any media, including in paid advertising and on social media.

You represent and warrant that you own or control all rights to the User Content; that the content is accurate and non-deceptive; and that its use by SylvanSport will not infringe any third-party rights or violate any applicable law. You agree to indemnify SylvanSport for any claims arising from User Content you submit.

Prohibited Uses

You agree not to use the Site or our services for any unlawful purpose or in any way that violates these Terms. Prohibited conduct includes but is not limited to:

  • Attempting to gain unauthorized access to any portion or feature of the Site or any other system or network connected to the Site.
  • Using any automated system (bots, scrapers, spiders) to access the Site in a manner that sends more requests than a human can reasonably produce in the same period.
  • Transmitting any unsolicited or unauthorized advertising or promotional material.
  • Engaging in any conduct that could damage, disable, overburden, or impair the Site.
  • Impersonating any person or entity or falsely claiming an affiliation with any person or entity.
  • Engaging in fraud, misrepresentation, or any other illegal activity.
  • Using the Site to purchase products for resale without prior written authorization from SylvanSport.

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

SYLVANSPORT DOES NOT WARRANT THAT (A) THE SITE WILL MEET YOUR REQUIREMENTS; (B) THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE SITE WILL BE CORRECTED.

Some states and provinces do not allow exclusion of implied warranties, so portions of the above disclaimer may not apply to you. In such jurisdictions, our warranties are limited to the greatest extent permitted by applicable law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SYLVANSPORT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES—INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR THE COST OF SUBSTITUTE GOODS—ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF SYLVANSPORT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SYLVANSPORT’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU TO SYLVANSPORT FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions—including certain Canadian provinces—do not allow limitations of liability for personal injury or certain other damages. In such jurisdictions, liability is limited to the extent permitted by applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless SylvanSport, LLC and its officers, directors, employees, agents, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your use of the Site or products, your User Content, or your violation of any rights of a third party.

Governing Law & Dispute Resolution

Governing Law
These Terms and any dispute arising out of or related to these Terms or the Site shall be governed by and construed in accordance with the laws of the State of North Carolina, United States of America, without giving effect to any choice of law or conflict of law provisions.

Dispute Resolution

If a dispute cannot be resolved informally, any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Transylvania County, North Carolina, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.

Waiver of Class Actions
TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Canadian Customers

SylvanSport welcomes customers from Canada. Canadian customers should be aware of the following:

  • Currency: All prices are in U.S. Dollars. Currency exchange rates and fees are determined by your financial institution.
  • Import duties & taxes: All applicable Canadian customs duties, GST/HST/PST, and brokerage fees are the sole responsibility of the customer and are not included in the purchase price.
  • Shipping timelines: Cross-border shipping may be subject to customs delays outside SylvanSport’s control.
  • Consumer protection laws: Nothing in these Terms is intended to limit any rights you may have under applicable Canadian consumer protection laws, including provincial legislation. To the extent any provision of these Terms is unenforceable under applicable Canadian law, such provision shall be deemed modified to the minimum extent necessary to make it enforceable.
  • Language: These Terms are written in English. Upon request, we will endeavor to make a French-language version available in accordance with applicable Quebec law requirements.
Changes to These Terms

SylvanSport reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last Updated” date, and, where appropriate, by sending an email notification or displaying a prominent notice on our Site.

Your continued use of the Site or purchase of our products after any such modification constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, your sole remedy is to discontinue use of the Site and our services.
