Origin and History
California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (commonly referred to as “Prop 65”) is a state law that requires manufacturers and retailers to label products when certain chemicals are present in a product that have been identified by the State of California to cause cancer or reproductive harm. California rarely conducts any independent scientific review to determine if any of these chemicals cause cancer or reproductive harm. Typically, chemicals are automatically added to a list (which has now grown to over 900 chemicals) when a report or scientific body makes a finding that shows a possible correlation between the chemical and the potential harmful effects. This law has resulted in an overwhelming amount of litigation, which is very challenging for manufacturers to deal with. The law offers a “safe harbor” for manufacturers that use the recommended warning language on their products and as such, many manufacturers have taken advantage of this “safe harbor” and added the warning language to its products.
APPLICABILITY TO SYLVANSPORT
Why is it Required on SylvanSport Products?
The Prop 65 warning is required on specific SylvanSport products because these products contain steel or stainless steel components or other components. All types of steel contain a chemical called nickel, which has been deemed by California to potentially cause cancer, and is “under consideration” for causing reproductive harm. Nickel is present in all steel (not just SylvanSport’s steel) and in higher concentrations in stainless steel. California law mandates that consumers need to be made aware of these risks and because of this mandate SylvanSport has added the Prop 65 warning language to assist consumers in making these informed decisions.
TRANSPARENCY IN SUPPLY CHAINS ACT
California’s Transparency in Supply Chains Act of 2010 requires certain disclosures regarding products sold to California’s consumers. SylvanSport, LLC believes that the use of forced or trafficked labor is unacceptable under any circumstances and applauds the efforts that are being undertaken to end these practices. SylvanSport does not manufacture the tires it sells at retail and relies on its suppliers to assess, audit, and verify the existence and implementation of the policies and practices of manufacturers to ensure that their products are free from the taint of slavery and human trafficking and that materials incorporated in their products comply with relevant local regulations. For the same reason, SylvanSport also does not maintain its own standards or procedures or train employees with respect to these matters.
MOTOR VEHICLES
California requires the following notice:
WARNING: Motor vehicles contain fuel, oils and fluids, battery posts, terminals and related accessories which contain lead and lead compounds and other chemicals known to the State of California to cause cancer, birth defects and other reproductive harm. These chemicals are found in vehicles, vehicle parts and accessories, both new and as replacements. When being serviced, these vehicles generate used oil, waste fluids, grease, fumes and particulates, all known to the State of California to cause cancer, birth defects, and reproductive harm.
